These Terms & Conditions explain the rules that apply when you use custompvcpatches.co.uk, request a quotation from us, approve artwork, place an order or purchase custom PVC patches or related products from Custom PVC Patches.
Please read these Terms & Conditions carefully before placing an order.
By placing an order with us, you agree to these Terms & Conditions together with any quotation, invoice, approved digital proof and other written specifications forming part of your order.
Nothing in these Terms & Conditions affects any statutory rights that cannot legally be excluded or restricted.

References to “Custom PVC Patches”, “we”, “us” or “our” in these Terms & Conditions mean the business supplying your order.
References to “you”, “your” or “customer” mean the individual, company, organisation, club, unit, charity or other customer requesting or purchasing goods from us.
2. Who These Terms Apply To
These Terms & Conditions apply to both consumers and business customers unless a particular section states otherwise.
A consumer is an individual purchasing goods mainly for personal use rather than for purposes connected with a trade, business, craft or profession.
A business customer includes a company, partnership, sole trader, organisation, club, public body, charity or other person purchasing mainly for business or organisational purposes.
Different legal rights may apply depending on whether you are purchasing as a consumer or as a business.
3. Our Products
We specialise in made-to-order PVC patches produced to customer specifications and artwork.
Depending on the order, products may include:
- 2D PVC patches
- 3D PVC patches
- custom die-cut PVC patches
- glow-in-the-dark PVC patches
- reflective PVC patches
- PVC and embroidery combination patches
- PVC name patches
- oversized PVC patches
- PVC patches with hook-and-loop backing
- sew-on PVC patches
- adhesive-backed PVC patches
- plain-backed PVC patches
- PVC patches with other agreed attachment methods
- other custom PVC products shown or agreed through our website or quotation process
Custom PVC patches are manufactured specifically for the customer using the artwork, dimensions, colours, relief, backing, quantity and other specifications agreed before production.
There is no minimum order quantity unless a particular quotation or product specification states otherwise.
4. Product Information
We take reasonable care to describe our products accurately.
General specifications displayed on our website are intended to help customers understand the products available. The exact specification of your order will be determined by the quotation, artwork, digital proof and any other details expressly agreed with us.
Where there is a conflict between general information on the website and the specific written details in an accepted quotation or approved proof, the specific details agreed for your order will normally take priority.
You should review all order-specific information carefully before approving production.
5. Requesting a Quotation
Requesting a quotation does not by itself create a binding order.
To prepare a quotation, we may ask you for information including:
- artwork or design files;
- required patch size;
- required quantity;
- 2D or 3D construction;
- number of colours;
- preferred Pantone references;
- backing type;
- delivery destination;
- required turnaround;
- any specialist finish or manufacturing requirements.
You are responsible for providing accurate information.
If information supplied to us is incomplete, inaccurate or changes after quotation, we may need to revise the price, specification or estimated turnaround.
6. Quotations
Our quotations are based on the information available when they are prepared.
A quotation may include the cost of:
- artwork preparation;
- digital proof preparation;
- mould engraving;
- PVC production;
- colour application;
- backing;
- finishing;
- inspection;
- packaging;
- delivery;
- other agreed services.
The quotation will state the price applicable to the particular order.
Unless otherwise stated, prices are quoted in pounds sterling.
Any VAT or other tax legally chargeable on the order will be identified on the relevant quotation or invoice where applicable.
A quotation does not guarantee acceptance of an order indefinitely. We may issue an updated quotation where specifications, quantities, delivery requirements, material costs or other relevant circumstances change.
7. When a Contract Is Formed
A contract between you and Custom PVC Patches is formed when we accept your order.
Acceptance may take place when we:
- confirm the order in writing;
- issue an order confirmation;
- accept the required payment;
- confirm that production can proceed; or
- otherwise clearly confirm acceptance of your order.
A quotation alone is not acceptance of an order.
We may refuse an order before acceptance where there is a legitimate reason to do so.
Examples include orders involving unlawful content, suspected intellectual property infringement, technically unworkable artwork, unavailable production options or circumstances where we cannot reasonably fulfil the specification.
8. Artwork Submission
Customers may submit artwork in formats including vector artwork, raster images, photographs, JPEG files or sketches.
Where required, our design process converts customer artwork into a production-ready layout suitable for PVC moulding.
The ability to reproduce a design depends on factors including:
- patch dimensions;
- line thickness;
- text size;
- relief depth;
- number of colours;
- separation between design elements;
- backing;
- shape;
- moulding limitations.
We may recommend changes where artwork cannot be manufactured accurately in its original form.
Any recommended changes will normally be shown in the digital proof before production.
9. Your Rights to Submitted Artwork
You must have the necessary rights, licences, permissions or authority to ask us to reproduce the artwork you submit.
By submitting artwork, you confirm that, to the best of your knowledge, manufacturing the requested products will not unlawfully infringe another person’s copyright, trade mark, design right or other intellectual property rights.
This applies to material including:
- company logos;
- brand marks;
- illustrations;
- photographs;
- characters;
- emblems;
- club insignia;
- organisational badges;
- unit insignia;
- text;
- slogans;
- artwork created by third parties.
Submitting artwork to us does not transfer ownership of your underlying intellectual property to Custom PVC Patches.
You give us permission to use the submitted artwork only to the extent reasonably necessary to quote for, design, proof, manufacture, inspect, package and fulfil your order.
We may refuse, suspend or cancel production if we reasonably believe that supplied artwork is unlawful or infringes third-party rights.
10. Digital Proofs
A digital proof is prepared before production of a custom patch.
The proof allows you to review important production details including, where applicable:
- wording;
- spelling;
- layout;
- patch shape;
- dimensions;
- colour references;
- design positioning;
- 2D or 3D relief;
- backing;
- other visible specifications.
You must check the proof carefully.
Please pay particular attention to names, numbers, dates, spelling, measurements and other details supplied by you.
Production does not normally begin until the required proof has been approved.
11. Approval of the Digital Proof
Approval of a digital proof means that you authorise us to manufacture the goods according to the approved design and agreed specifications.
Once you approve the proof, responsibility for checking the visible design details passes to you.
If an error was present in the proof and you approved that error, the resulting product will not normally be regarded as defective solely because it reproduces the approved design.
This does not apply where the goods do not match the approved proof, are faulty, are incorrectly manufactured or otherwise fail to meet rights that apply under law.
If you request changes after proof approval, we will tell you whether the change remains possible.
Changes requested after mould engraving or production has started may involve additional costs, a new mould, additional production time or a completely new order.
12. Colours and Pantone Matching
Custom PVC patches can be produced using agreed Pantone Matching System references.
Where a Pantone reference has been agreed, that reference forms part of the production specification.
Digital screens, phones, tablets and monitors can display colours differently. For this reason, the appearance of a colour on a digital proof should not be treated as an exact physical colour reference where a specific Pantone reference has also been agreed.
Customers requiring a specific brand colour should provide or approve the relevant Pantone reference before production.
If no specific Pantone reference is supplied, colours will be produced according to the colours agreed through the proofing process.
13. Moulds and Tooling
Custom PVC patch production requires a mould based on the approved design.
Where our quotation states that mould engraving is included, there will be no separate mould charge unless otherwise expressly stated.
Moulds for approved designs may be retained for future reorders.
Retention of a production mould does not give us ownership of the customer’s underlying logo, artwork, trade mark or other intellectual property.
A reorder may still require a new quotation.
Changes to the original artwork, dimensions, relief or construction may require a new or modified mould.
14. Reorders
A reorder is an additional production run based on a previously approved design.
Where the original mould remains usable and the specification is unchanged, reorders may avoid the need for the original mould to be re-engraved.
Reorder prices are not permanently fixed unless we have expressly agreed otherwise.
Current quantity, material, backing, production, delivery and other costs may affect the price of a future reorder.
You should check the new quotation before confirming a reorder.
15. Prices
The price payable is the price shown in the quotation or invoice accepted for your order.
Pricing may depend on factors including:
- size;
- quantity;
- 2D or 3D relief;
- colour count;
- backing;
- special finishes;
- production speed;
- delivery requirements;
- changes requested after quotation.
Larger production quantities may result in a lower unit price because production and tooling costs can be distributed across the run.
We reserve the right to correct genuine pricing or calculation errors before an order is accepted.
If an error is identified after you have submitted payment but before production, we will contact you before proceeding.
We will not simply charge a higher price without your agreement.
16. Payment
Payment requirements will be stated on the relevant quotation, invoice or order confirmation.
Where payment is required before production, production will not begin until the required payment has been received or otherwise confirmed.
Where we have expressly agreed credit terms with a business customer, payment must be made according to those agreed terms.
You must pay all undisputed amounts when due.
If payment is delayed, any estimated production or delivery date may also be delayed.
17. Production Times
Standard production is normally estimated at 10 to 14 working days from proof approval.
Where express production is available and has been agreed, production is normally estimated at 5 to 7 working days from proof approval.
Production time begins after the required digital proof has been approved, not when the first enquiry is submitted.
Production estimates may change if:
- proof approval is delayed;
- the customer requests changes;
- additional artwork work is required;
- specifications change;
- payment is delayed;
- specialist materials or finishes are required;
- circumstances outside our reasonable control affect production.
Where a specific delivery deadline is essential, you must tell us before placing the order.
We will only treat a particular deadline as guaranteed where we have expressly agreed that deadline in writing.
18. Delivery
Orders are delivered to the address agreed for the order.
UK orders may be sent using tracked delivery services including Royal Mail or DPD.
BFPO delivery is available where agreed for eligible orders.
You are responsible for providing a complete and accurate delivery address.
We are not responsible for delays caused solely by an incorrect or incomplete address supplied by the customer, although we will provide reasonable assistance where possible.
Any delivery estimate will be stated or communicated as part of the order process.
For UK mainland addresses, delivery after despatch is normally expected to take approximately 1 to 2 working days where that service applies.
Carrier delivery times are separate from production times.

19. Delivery Delays
We aim to meet agreed production and delivery estimates, but events outside our reasonable control can sometimes cause delays.
These may include courier disruption, severe weather, transport interruption, industrial action, customs or border disruption, supplier failure, equipment failure, power interruption or other events that could not reasonably have been prevented.
Where a significant delay affects your order, we will take reasonable steps to keep you informed and minimise the effect.
Nothing in this section removes any cancellation, refund or other right that a consumer has where a legally required delivery deadline is missed.
20. Risk and Ownership
For consumer orders, responsibility for accidental loss of or damage to the goods passes to you when the goods are delivered into your physical possession or the possession of a person you have identified to receive them.
Ownership of goods will not pass until the amounts due for those goods have been paid in full.
For business customers, any different risk or ownership arrangement stated in an accepted quotation, invoice or written agreement will apply.
21. Custom-Made Goods and Change-of-Mind Cancellations
Our PVC patches are normally manufactured to the customer’s individual artwork, dimensions, colours, backing and other specifications.
They are therefore bespoke goods made specifically for the customer rather than standard stock products.
The normal statutory cooling-off right available for many online purchases does not generally apply to goods made to the consumer’s specifications or clearly personalised.
This means that once you place an order for custom-made goods, you should not assume that you can cancel simply because you change your mind.
However, we encourage customers to contact us as quickly as possible if circumstances change.
Where production has not begun, we may agree to a cancellation, amendment or credit at our discretion where reasonably practical.
Whether this is possible will depend on the stage reached and the work or costs already committed to the order.
This change-of-mind rule does not remove your legal rights where goods are faulty, misdescribed, incorrectly manufactured or otherwise fail to conform to the contract.
22. Changes Before Production
If you need to change an order before production, contact us immediately.
We will tell you whether the change is possible.
Changes may affect:
- artwork;
- dimensions;
- quantity;
- backing;
- colours;
- relief;
- mould;
- price;
- production time;
- delivery date.
A revised proof may be required.
Production will not proceed on the revised design until any required approval has been received.
23. Changes After Production Has Started
Once mould engraving or production begins, changes become significantly more difficult.
If you request a change after this point, we may need to:
- stop the existing production run;
- create new artwork;
- engrave or modify a mould;
- remake some or all goods;
- revise the price;
- extend the turnaround time.
We will explain any additional cost before carrying out chargeable additional work.
24. Faulty or Incorrect Goods
Consumers have statutory rights in relation to goods.
Nothing in these Terms & Conditions removes or reduces those rights.
If goods are:
- faulty;
- damaged before delivery;
- materially different from the approved proof;
- materially different from the agreed specification;
- not as described;
- otherwise non-conforming,
please contact us as soon as reasonably possible.
We may ask you to provide:
- your order details;
- photographs;
- measurements;
- photographs of packaging;
- details explaining the issue.
This helps us investigate the problem.
Depending on the circumstances and your legal rights, an appropriate remedy may include repair, replacement, remake, price reduction or refund.

25. Manufacturing Characteristics
PVC patches are physical moulded products.
An approved digital proof represents the intended design, layout, colour references and specifications, but it is not itself the finished physical product.
Minor characteristics inherent in physical manufacturing do not automatically mean that goods are defective.
We will assess any reported issue against:
- the approved proof;
- the agreed specifications;
- the nature of the material;
- normal manufacturing standards;
- any applicable statutory rights.
A material difference from the approved specification will be treated differently from a trivial variation that has no meaningful effect on appearance or use.
26. Incorrect Customer-Supplied Information
You are responsible for checking information you supply to us.
This includes:
- spelling;
- dates;
- names;
- telephone numbers;
- identification numbers;
- wording;
- logos;
- dimensions;
- colours;
- delivery addresses;
- quantities.
If we manufacture goods accurately according to information and artwork approved by you, we are not responsible for an error that existed solely within the approved customer-supplied information.
We will nevertheless try to help where possible.
A remake required solely because customer-approved information was incorrect may be treated as a new chargeable order.
27. Samples
Where a physical or pre-production sample is ordered or agreed, the purpose of the sample is to allow the relevant characteristics to be reviewed before the main production run.
Any approval procedure applying to that sample will be explained with the order.
If you approve a sample, the approved sample may form part of the agreed production specification for the remaining quantity.
28. Customer-Supplied Requirements
If you tell us that a product is required for a particular purpose, environment or application, you should give us enough information to understand the requirement before ordering.
Different applications may require different sizes, backings, materials or construction.
For example, hook-and-loop backing, sew-on backing, adhesive backing and plain backing are designed for different attachment methods.
You remain responsible for selecting and using the product appropriately unless we have expressly agreed that a particular specification is suitable for a particular stated purpose.
Nothing in this clause removes consumer rights relating to goods sold as fit for a particular purpose.
29. Product Care and Use
Customers should follow any care, washing, attachment or use instructions supplied with the product or published in the relevant guidance on our website.
Damage caused solely by misuse, inappropriate attachment, exposure outside the agreed specification or failure to follow reasonable care instructions is not a manufacturing defect.
This does not affect rights relating to defects that were already present when the goods were supplied.
30. Website Information
We aim to keep information on custompvcpatches.co.uk accurate and up to date.
However, product options, turnaround estimates, prices, services and specifications may change.
Order-specific information confirmed in your quotation and approved proof forms the primary specification for your particular purchase.
Nothing on the website should be interpreted as guaranteeing availability of every combination of product specification until we accept the relevant order.
31. Website Intellectual Property
Unless otherwise stated, the website design, written content, original graphics, photographs, diagrams and other material created for Custom PVC Patches are protected by applicable intellectual property law.
You may use the website for ordinary personal or business purchasing and informational purposes.
You must not reproduce, republish, scrape, sell or commercially exploit substantial parts of our original website content without permission, except where the law allows it.
This section does not give us ownership of artwork, logos or other intellectual property submitted by customers.
32. Privacy and Personal Information
We process personal information required to respond to enquiries, prepare quotations, process orders, communicate with customers and fulfil deliveries.

33. Communications
We may communicate with you by email, telephone or another contact method provided during the enquiry or order process.
You are responsible for providing accurate contact information and for informing us if those details change.
Important order communications may include:
- quotations;
- proof requests;
- revised artwork;
- proof approval requests;
- payment information;
- production updates;
- delivery updates;
- questions about specifications.
A delay in responding to an approval request may delay production.
34. Our Responsibility to Consumers
We do not exclude or limit liability where doing so would be unlawful.
Nothing in these Terms & Conditions excludes or limits liability for matters that cannot legally be excluded or limited.
Nothing in these terms removes a consumer’s statutory rights relating to faulty, misdescribed or non-conforming goods.
For consumer customers, we are responsible for losses that are a foreseeable consequence of our breach of contract or failure to use reasonable care and skill, subject to applicable law.
We are not responsible to consumer customers for business losses arising from a purchase made primarily for personal purposes.
35. Our Responsibility to Business Customers
This section applies only where you purchase as a business customer.
To the fullest extent permitted by law, we will not be responsible for indirect or consequential business losses including loss of profit, loss of revenue, loss of anticipated savings or loss of business opportunity where such loss was not directly caused by our breach.
Unless otherwise agreed in writing, our total liability to a business customer in relation to an affected order will not exceed the total amount paid or payable to us for that affected order, except where liability cannot lawfully be excluded or restricted.
Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability that cannot legally be excluded.
36. Events Outside Our Reasonable Control
We are not responsible for a failure or delay caused by circumstances genuinely outside our reasonable control.
Where such an event affects an order, we will take reasonable steps to reduce disruption.
If the event creates a significant delay, we will contact the customer where reasonably possible.
Consumer rights that apply because of a prolonged or legally significant delay remain unaffected.
37. Refusing or Cancelling an Order
We may refuse or cancel an order before completion where there is a legitimate reason, including where:
- the requested product cannot reasonably be manufactured;
- the artwork appears unlawful or infringing;
- the customer does not approve the proof;
- required payment is not made;
- necessary information is not provided;
- fulfilling the order would breach law or regulation;
- an obvious pricing or specification error cannot be resolved;
- circumstances outside our reasonable control make fulfilment impossible.
Where we cancel an accepted consumer order and the cancellation is not caused by the customer’s breach, we will refund amounts paid for goods we will no longer supply, subject to applicable law.
38. Customer Behaviour
We expect communication between customers and our staff or representatives to remain lawful and reasonable.
We may restrict communication channels or refuse future orders in response to threatening, abusive, fraudulent or unlawful behaviour.
This will not remove obligations relating to an existing order or statutory rights already held by a customer.
39. Complaints and Problems

If there is a conflict between that policy and a mandatory legal right, the legal right takes priority.
41. Changes to These Terms
We may update these Terms & Conditions from time to time.
The version applying to an order will normally be the version in effect when the relevant contract is formed, unless a later change is required by law or both parties agree otherwise.
Changes to website terms will not retrospectively remove rights already acquired under an existing order.
The “Last updated” date at the top of this page identifies the current published version.
42. If Part of These Terms Is Invalid
If a court or competent authority finds that part of these Terms & Conditions is unlawful or unenforceable, the remaining provisions will continue to apply so far as legally possible.
Any invalid provision will be treated separately from the remainder of the terms.
43. No Waiver
If we do not immediately enforce a provision of these Terms & Conditions, that does not mean that we have permanently waived the right to enforce it.
Similarly, exercising one right does not prevent either party from exercising another right available under the contract or law.
44. Entire Agreement for Business Customers
For business customers, the accepted quotation, these Terms & Conditions, the approved proof and any written order-specific agreement together form the agreement relating to the relevant order.
Nothing in this section excludes liability for fraud or fraudulent misrepresentation.
This section does not restrict mandatory consumer rights.
45. Governing Law
These Terms & Conditions and contracts with Custom PVC Patches are governed by the applicable laws of Scotland, subject to any mandatory consumer protections that apply.
If you are a consumer, nothing in this section deprives you of mandatory rights or protections available to you under applicable UK law.
For business-to-business contracts, the courts of Scotland will have jurisdiction unless we agree otherwise in writing.
